What if you get a DUI in the middle of your insurance term?

If you have a DUI conviction in the middle of your policy term, there are two thing likely to happen. First it is likely that you will see an increased insurance premium, and be labeled a "high risk" driver. You'll have to file an SR-22 - proof of financial responsibility - with your state's department of motor vehicles, and carry it for up to five (but generally three) years. State laws vary widely, so make sure you research the laws in your area. As well, in some states your insurance can be cancelled mid-term as soon as a conviction occurs. (Of course, in some states it's against the law to drop you mid-term.) Whether this happens or not, however, chances are you will need to start shopping for new insurance, to be placed as soon as your existing coverage ends.

While the prospect of having insurance summarily canceled is frightening, it is possible that your insurer may not find out. A study done five years ago by the Insurance Research Council suggested that up to one fourth of all driving convictions are never put on motor vehicle records, either because the courts neglect to release the information, or because the driver elects to go to traffic school, or use some other way to "erase" the citation. Getting your charge reduced, or agreeing to a limited suspense of your license may mitigate the need for an SR-22 filing, and without that, your insurance company may never find out. Once they do, however, most states give them three years to either cancel your coverage or increase your rates.

There are a few insurance companies that don't automatically raise your premiums when you have a DUI conviction, if the rest of your record is clean, and you have a spotless payment history. This, however is rare, and you should not count on it.
